By accessing, browsing, or using our Site, or by purchasing any products, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Site or purchase our products.

 

1. IMPORTANT: HEALTH & MEDICAL DISCLAIMER

1.1 Not Therapeutic Goods: The health and wellness patches ("Products") sold on this Site are designed to support general wellbeing. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

1.2 No TGA Evaluation: The claims made about our Products have not been evaluated by the Australian Therapeutic Goods Administration (TGA).

2. ELIGIBILITY AND ACCOUNT

2.1 To purchase Products through our Site, you must be at least 18 years of age (or have the consent of a parent/guardian) and possess a valid payment method accepted by us.

2.2 You must ensure that all information provided during the checkout or account registration process is accurate, complete, and up-to-date.

 

3. ORDERS AND CONTRACT FORMATION

3.1 Order Placement: By placing an order, you are making an offer to purchase the selected Products in accordance with these Terms.

3.2 Order Acceptance: We reserve the right to accept or reject your order at our discretion (e.g., due to stock unavailability, errors in pricing, or suspected fraud). A contract is only formed when we dispatch the Products to you and send a shipping confirmation email.

3.3 Product Availability: While we strive to maintain accurate inventory, our Products are manufactured overseas and distributed from Australia. Occasionally, supply chain delays may occur. If we cannot fulfill your order, we will notify you and process a full refund.

 

4. PRICING AND PAYMENT

4.1 Currency & GST: All prices are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless otherwise stated.

4.2 Changes to Pricing: Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed.

4.3 Payment Methods: We use secure third-party payment gateways. By submitting your payment details, you warrant that you are fully authorized to use the chosen payment method.

 

5. SHIPPING AND DELIVERY

5.1 Dispatch Location: All orders are picked, packed, and dispatched from our facilities within Australia.

5.2 Delivery Times: Delivery times provided are estimates. While we use reliable couriers, external factors can cause delays.

5.3 Partial Delivery: We may deliver the Products in instalments if they are not all available at the same time for delivery.

5.4 Delivery Guarantee: We stand by our shipping process. Please see Section 6.2 for our Money Bank Guarantee regarding lost or non-delivered items.

5.5 Title and Risk: Title to the Products and risk of loss or damage pass to you upon delivery of the Products to the shipping address provided.

 

6. RETURNS, REFUNDS, AND AUSTRALIAN CONSUMER LAW

6.1 Australian Consumer Law (ACL): Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

6.2 Money Back Guarantee (Damage & Non-Delivery): We want you to shop with confidence. In alignment with your ACL rights, we offer a strict Money Back Guarantee for transit issues:

  • Damaged on Arrival: If your Product arrives damaged or defective, please contact us at help@goodnesspatch.com within 7 days of receipt with a photo of the damage. We will verify the issue and promptly issue a full refund or a free replacement - your choice.
  • Failed Delivery / Lost in Transit: If your order fails to be delivered and is deemed lost by our courier, we will issue a full refund or dispatch a replacement order at no cost to you. (Please note: This guarantee does not apply if the courier provides proof of delivery to the correct address provided at checkout, or if the failure was due to an incorrect address entered by you).

6.3 Change of Mind: We do not offer refunds for "change of mind" due to the health and hygiene nature of our Products.

6.4 Faulty Products: If you believe your Product is faulty, please contact us at help@goodnesspatch.com within 7 days of receiving the item, including photos and a description of the issue, so we can facilitate a replacement or refund under the ACL.

 

7. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to logos, text, graphics, images, product designs, and software, is the property of The Goodness Patch Co Ltd or our licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

 

8. LIMITATION OF LIABILITY

8.1 To the maximum extent permitted by law, including the Australian Consumer Law, The Goodness Patch Co Pty Ltd, its directors, employees, and suppliers shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Site or Products.

8.2 Our total liability to you for any claim arising out of these Terms or your purchase of a Product is limited to the amount you paid for the Product.

 

9. PRIVACY

10. SEVERABILITY

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales.
